    Shipping policy

    Effective as of 10/02/2026

    ARTICLE 1. PURPOSE

    This shipping policy defines the terms and conditions applicable to the shipment of a Product to the Client by the Publisher.

    ARTICLE 2. PARTIES

    This shipping policy applies between BRBCLUB, hereinafter referred to as “the Publisher,” and any individual or legal entity, whether private or public, registered on the Website to purchase a Product, hereinafter referred to as “the Client.”

    ARTICLE 3. DEFINITIONS

    “Client”: any individual or legal entity, whether private or public, registered on the Website.

    “Website Content”: elements of any kind published on the Website, whether or not protected by intellectual property rights, such as texts, images, designs, presentations, videos, diagrams, structures, databases, or software.

    “The Publisher”: BRBCLUB, acting as the Website’s publisher.

    “Internet User”: any individual or legal entity, whether private or public, connecting to the Website.

    “Product”: any item sold on the Website by the Publisher to Clients.

    “Website”: the website accessible at the URL www.brbclub.ch, as well as its sub-sites, mirror sites, portals, and related URL variations.

    ARTICLE 4. SCOPE

    The Website is freely accessible to any Internet User. By navigating the Website, any Internet User accepts this shipping policy. Merely connecting to the Website, by any means, including via a robot or a browser, constitutes full acceptance of this shipping policy. During registration, acceptance will be confirmed by checking the appropriate box.

    The Internet User acknowledges that they have fully read and accepted this policy without restriction.

    Checking the aforementioned box is equivalent to a handwritten signature by the Internet User. The Internet User acknowledges the evidentiary value of the Publisher's automated recording systems and, unless proven otherwise, waives the right to contest them in case of a dispute.

    This shipping policy applies to the relationship between the parties, to the exclusion of all other conditions, including those of the Internet User.

    Acceptance of this shipping policy requires Internet Users to have the necessary legal capacity or, if not, to have authorization from a guardian or trustee if incapacitated, from their legal representative if a minor, or to hold a mandate if acting on behalf of a legal entity.

    ARTICLE 5. DELIVERY

    5.1. Shipping Costs
    Shipping or delivery fees will, in all cases, be indicated to the Client before any payment. For delivery outside of Switzerland, the Client must contact customer service.

    In the case of delivery to a store or a partner location of the Publisher, any applicable fees will be communicated to the Client at the time of ordering.

    The delivery fees listed on the Website are in Swiss francs (CHF), including all taxes.

    5.2. Delivery Time
    Orders are delivered by a Swiss postal service within 14 business days for Switzerland and 30 business days for foreign countrys from the Publisher’s receipt of full payment.

    Certain products or order volumes may justify a delivery time exceeding 20 business days. This will be expressly indicated to the Client upon order confirmation.

    5.3. Damaged Parcel
    In the event of visibly damaged delivery, the Client must refuse the parcel to benefit from the carrier's guarantee. The Client must also promptly notify the Publisher at contact@brbclub.ch so that a new parcel can be prepared and shipped once the damaged parcel has been returned. In such cases, the delivery times specified in these terms will no longer apply.

    5.4. Retention of Ownership - Transfer of Risk
    Ownership of delivered Products remains with the Publisher until the Products are delivered to the Client, notwithstanding any contrary clause, unless the parties have expressly agreed in writing to waive this clause.

    The Client assumes the risks related to the Products from the time of order. During the retention of ownership period, the Client must insure the Products belonging to the Publisher against all damages and provide proof of this to the Publisher upon request.

    ARTICLE 6. FINAL PROVISIONS

    6.1. Governing Law
    This shipping policy is governed by Swiss law.

    6.2. Amendments to This Shipping Policy
    The Publisher may amend this shipping policy at any time. The shipping policy applicable to the Client is the one in effect on the day of their order or connection to the Website, with each new connection to the personal account constituting acceptance of the revised shipping policy, if applicable.

    6.3. Disputes
    Any disputes with a consumer Client arising from the execution of these general terms and conditions and unresolved amicably between the parties must be submitted for resolution under Swiss jurisdiction.

    Since January 1, 2016, mediation is mandatory for all. Therefore, any professional selling to individuals is required to provide the contact details of a competent Mediator in case of a dispute.

    6.4. Entire Agreement
    The invalidity of any clause of this contract does not invalidate the other clauses of the contract or the contract as a whole, which shall remain in full force and effect. In such a case, the parties shall, as far as possible, replace the invalid provision with a valid one that reflects the spirit and purpose of these terms.

    6.5. Non-Waiver
    The Publisher’s failure to exercise any rights under these terms shall not be interpreted as a waiver of those rights.

    6.6. Language of This Shipping Policy
    This shipping policy is available in French.

    6.7. Unfair Clauses
    The provisions of this shipping policy apply subject to compliance with the imperative provisions of Swiss law concerning unfair clauses in contracts concluded between a professional and a consumer.
